Terms and Conditions

International Community Competition

 

The following products will be given away in the scope of the competition:

1x ULTIMA 40, 1x ROCKSTER CROSS, 1x REAL BLUE PRO, 1x MYND, 1x CINEBAR 11 for Dolby Atmos 2.1-Set, 1x MOTIV® HOME, 1x BOOMSTER.

The competition shall begin when the competition post is published on our official Instagram page (@teufelaudio_international) on 02/06/2025. The deadline for entry shall be 20/06/2025, at 23:59. In order to enter the competition, you must comment on the aforementioned competition post.            

Terms and Conditions

 

This competition is organized by Lautsprecher Teufel GmbH, Budapester Str. 44, 10787 Berlin for participants residing in the European Economic Area and Switzerland, as long as Teufel delivers to the country in question (See all countries here:https://support.teufel.de/hc/en-us/articles/22903502875282-Which-countries-does-Lautsprecher-Teufel-deliver-to).

 

§ 1 Participation

(1)    The competition is open to natural persons who are at least 18 years old at the time of entry, with the exception of legal representatives and employees of Lautsprecher Teufel GmbH and their relatives and persons living with them in the same household. Participants may only make entries in their own name, and only one time per person. Entries for third parties are inadmissible. Entering requires logging into Instagram with one's own Instagram account.

(2)    Participants take part in the competition by commenting on the official Instagram page of Lautsprecher Teufel GmbH with the answer to a question posed by the competition post. The competition shall begin when the competition post is published on the Instagram page of Lautsprecher Teufel GmbH. Entries may only be made until the end of the competition on 20/06/2025 at 23:59. The timeliness of a participating comment is determined solely by the time the comment is received.

(3)    Participation in the competition is voluntary and the participants are required to acquaint themselves with the terms and conditions before participating in the competition. Participation in the competition is equivalent to accepting the terms and conditions.

 

§ 2 Disqualification from the Competition

(1)    In case of violation of the previously enumerated terms and conditions, Lautsprecher Teufel GmbH reserves the right to disqualify persons from the competition.

(2)    Any persons found to be making use of disallowed resources or gaining an unfair advantage through any other form of manipulation or producing content contrary to current law, the rights of third parties, common decency, and/or the rules of social conduct will also be disqualified. In such cases, already announced wins may be rescinded and we may demand the return of any prizes awarded.

(3)    Anyone that makes false statements about their identity may be disqualified from the competition.

(4)    Persons who attempt to register multiple times or comment on the post with multiple accounts may be disqualified from participating.

 

§ 3 Implementation and Processing

(1)    All answers/comments, sent in the scope of this competition will be evaluated by an internal jury composed of three employees of Lautsprecher Teufel. The jury will evaluate answers received for originality and creativity and will choose the best answer in their opinion and at their own impartial discretion. The winners will be informed within one week of the end of the competition by comment on the competition post. The participants also consent, in case of a win, to be posted on the Instagram page of Lautsprecher Teufel GmbH along with their username

(2)    The winners must send us a private message to the international Instagram page of Lautsprecher Teufel GmbH within 14 days to say whether they will accept their prize. This will also require their full name, birthday, and the mailing address, email address and phone number to be shared. The winners alone are liable for the accuracy of the contact data. If the winner does not respond to us within this timeframe or makes false statements about their personal data which render the shipping of the prize impossible, their right to a prize will be rescinded. In this case, no new winner will be named. In no case is it possible to have the prize paid out in cash or other replacement.

(3)    Lautsprecher Teufel GmbH reserves the right to cancel or terminate the competition extraordinarily within a reasonable notice period and without stating reasons, in particular if due to technical (such as computer viruses, manipulation, or malfunctioning hardware or software) or legal issues, we cannot guarantee the game is carried out properly. If such termination is caused by the conduct of an authorized participant or third party and damage is suffered by Lautsprecher Teufel GmbH as a result, Lautsprecher Teufel GmbH may demand compensation for this damage from the person in question.

(4)    For delivery of the prizes to the respective winners, our general delivery conditions of the country of residence shall apply, such as here: https://lu.teufelaudio.com/gbc#_06. Lautsprecher Teufel GmbH shall bear the shipping costs for delivering the prizes to the place of residence specified by the winner.

(5)    If the delivery is made by a forwarding agent, the forwarding agent will contact the winner to arrange a delivery date. It is the responsibility of the winner to provide an alternative address in their immediate vicinity where the prize can be delivered in case of their absence. If it is not possible to deliver the prize to either the original or alternative address at the agreed upon time, the winner shall bear the costs of the subsequent delivery attempt.

(6)    The contractual 8-week return policy as laid out in clause 3 section C of Lautsprecher Teufel GmbH's General Business Conditions does not apply with regard to prizes. However, Lautsprecher Teufel GmbH does assume warranty obligations as laid out in clause 4 of Lautsprecher Teufel GmbH's General business conditions, see for example https://lu.teufelaudio.com/gbc#_04.

(7)    Participating in the competition is equivalent to the granting of a perpetual, free license to use the participants' answers, which are works in the sense of copyright law. This applies to all known areas of use, in particular with regard to distribution – public performance, reproduction, broadcast and rebroadcast as well as making it available to the public on the Internet in such a way that anyone could have access to it at a time and place of their choosing.

(8)    The granting of the license also includes consent to Lautsprecher Teufel's right to make changes and modifications to the content of the comments made in the context of this competition. In the event that the aforementioned changes and compilations are subject to related intellectual property rights, the participants hereby consent to the disposal and use of such subject matter by Lautsprecher Teufel.

 

§ 4 Prizes

(1)    The prizes will be listed in the relevant competition post. A detailed description of the possible prizes is generally possible to view at https://lu.teufelaudio.com/. Only non-cash prizes will be awarded.

(2)    Winnings cannot be paid out in cash or exchanged.

(3)     The prize claim cannot be transferred to third parties.

 

§ 5 Data protection

(1)    All personal data collected in this context will be stored and used in accordance with applicable regulations for the protection of personal data only for the purpose of processing the competition, in particular in order to contact the participant in the event of prize winning and to be able to send it to them. In addition, the data will not be used or transferred to third parties unless strictly necessary for processing the awarding of the prize. This applies in cases such as where third parties provide the prize for the competition.

(2)    All participants retain the rights afforded to them by the GDPR, including information, deletion, and correction with regards to the aforementioned data. (4)    If you win the grand prize and it must be sent to you, we will use your personal data, which you sent to us after being notified of your win by private message for this end and we will communicate it to a delivery service provider.

(5)    The provision of personal data by participants is voluntary but required to take part in the competition and – in case of winning – to receive the prize. If personal data is not provided, participation in the competition will not be possible thus precluding receipt of the prize. In case of defect-related complaint within our warranty period, provision of data is also voluntary. In this case, not providing data will mean that the complaint cannot be processed and no repair or replacement can be made.

 

§ 6 Liability and Miscellanea

(1)    Lautsprecher Teufel GmbH assumes no liability for any manipulation of the process of the competition.

(2)    Legal recourse with regard to the prize draw and any judging of competition entries is forbidden.

(3)    Objections regarding the proper execution of the competition can be made by participants within 30 days of the end of the competition in the form of an email directed to socialmedia@teufel.de . Objections should contain the first name, last name, address, and telephone number as well as a detailed description of the reason for the objection. Lautsprecher Teufel will make a decision on whether the objection is well founded within 14 days of its receipt. The decision shall be final, which does not preclude the participant’s right to pursue associated claims in court.

(4)    The only law that shall apply to this case is that of the Federal Republic of Germany, and no other international jurisdiction. This choice of legal system only applies to consumers to the extent that the consumer is not deprived of the protection granted by mandatory provisions of the country in which the consumer has their habitual residence.

(5)    Should any of these provisions be or become invalid, this shall not affect the validity of the other terms of use.

(6)    The competition is not affiliated with Instagram (Meta Platforms, Inc.) and is in no way sponsored, endorsed or organized by Instagram. The recipient of the data and information provided by the participant is not Instagram. It is instead only Lautsprecher Teufel GmbH.

(7)    For participants from Poland: The competition is not a game of chance or similar as laid out in the Polish Law on Games of Chance of November 19, 2009 (Dz. U. 2009, Nr. 201, Pos. 1540 with later amendments).

(8)   For participants from the Netherlands: Lautsprecher Teufel GmbH undertakes to comply with the 'Gedragscode promotionele kansspelen,' on which these conditions of participation base.
